1. Introduction
These Terms of Use and Service (“Terms”) govern your access to and use of our website, online forms, and memoir services (collectively, the “Services”) provided by Map Memoirs (“we”, “us”, “our”). By using our site, submitting our form, or engaging us for memoir services, you agree to be bound by these Terms.
If you do not agree, please do not use our Services.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use our Services. By using the Services, you represent that you meet this requirement.
3. Description of Services
We offer services related to capturing, writing, editing, designing, and delivering personal memoirs and life stories. The exact scope, timeline, and deliverables will be agreed with you in writing (for example, by email or a separate service agreement).
4. Your Responsibilities
You agree to:
Provide accurate, complete, and up-to-date information in our form and during any communications.
Not use our Services for any unlawful, fraudulent, defamatory, or harmful purpose.
Not submit content (such as photos) that infringes or violates the rights of others (including privacy, publicity, or intellectual property rights).
Obtain appropriate permission from any third parties whose personal information or stories you share with us, where required.
You remain responsible for the truthfulness and legality of the material you provide.
5. Intellectual Property and Use of Materials
You retain ownership of your personal stories, life events, and original content you provide to us (“Client Content”).
By submitting Client Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, edit, and otherwise process such content solely for the purpose of providing the Services, including editing, designing, and producing your memoir.
We own all intellectual property rights in any templates, processes, designs, and tools we use to deliver the Services, as well as our website content and branding. These are not transferred to you.
Unless otherwise agreed in writing:
You are granted a personal, non-transferable license to use the final memoir deliverables for private, non-commercial purposes (for example, sharing with family and friends).
If you intend to publish or commercially exploit the memoir (for instance as a book), we may require a separate agreement outlining rights, credits, and any additional fees.
6. Payment and Fees
Prices, packages, and payment terms will be communicated to you separately and/or displayed on our site.
Payment is due as stated in our invoices or order forms.
Payments are processed through third-party payment providers (Stripe); you agree to their terms and to provide accurate payment information.
You are responsible for any charges, fees, or taxes applied to your purchase in accordance with local laws.
7. Cancellations, Changes, and Refunds
Our cancellation and refund policy will be set out in your proposal, order confirmation, or separate agreement. In general:
Once substantial work has started on your memoir, only partial refunds (if any) may be available, to reflect the work already completed.
If you need to change the scope (e.g., length, format, number of copies), this may affect the timeline and cost and will require our mutual written agreement.
8. Timeline and Revisions
We will make reasonable efforts to meet any timelines agreed with you, but these are estimates and may change due to factors outside our control (for example, delays in receiving information or approvals from you).
We will generally provide one or more rounds of revisions (as agreed) so you can review and request reasonable edits before finalization. Additional revisions or substantial changes beyond the agreed scope may incur extra fees.
9. Confidentiality
We will treat your Client Content and personal information as confidential and will not disclose it to third parties except as necessary to provide the Services, as described in our Privacy Policy, or where required by law.
10. Disclaimers
The Services are provided with reasonable care and skill, but we do not guarantee that the site will be error-free, uninterrupted, or always available.
The memoir is based on your accounts and materials. We are not responsible for verifying the accuracy of factual statements you provide.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Services, except where such warranties cannot be excluded under applicable law.
11. Limitation of Liability
To the maximum extent permitted by law:
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
Our total aggregate liability to you for any claims arising from or related to the Services or these Terms shall be limited to the total amount you paid us for the specific project or service giving rise to the claim.
12. Termination
We may suspend or terminate your access to the Services, or our engagement, if:
You materially breach these Terms or any other agreement with us.
You fail to pay amounts due.
We reasonably believe your conduct is unlawful, abusive, or harms our business or other clients.
You may stop using the Services at any time. Termination does not affect rights and obligations that have already arisen (including payment obligations and intellectual property licenses already granted for completed work).
13. Changes to the Terms
We may update these Terms from time to time. The “Last updated” date at the top indicates when changes were made. If changes are material, we will provide a notice on our website or by email where reasonably possible. Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
14. Governing Law and Dispute Resolution
These Terms and any disputes arising from them or from the Services are governed by the laws of Greece and EU, without regard to conflict-of-law rules.
You agree that any disputes will first be addressed through good-faith negotiations. If we cannot resolve the matter amicably, disputes shall be subject to the exclusive (or non-exclusive, as you choose) jurisdiction of the courts of Greece/EU.
